Amendment to the Knox Planning Scheme

An amendment to the Knox planning scheme has introduced new Design and Development Overlays and Significant Landscape Overlays. The overlays have introduced a new requirement for a planning permit in many cases to construct a building or carry out works in areas of the municipality subject to the overlays. The overlays apply principally to the area known as the Dandenong foothills. Building surveyors who are currently assessing a building permit application in the City of Knox should check with the council prior to issuing the building permit to ensure that a planning permit is not required.

The Knox planning scheme has also introduced a schedule to the Residential 3 Zone which applies new standards to private open space and front fence height in streets other than a declared road. The schedule to the residential 3 zone will have no effect in the building permit system until an amendment is made to schedule 5 of the Building Regulations 2006. The Commission will provide advice to the industry prior to this taking effect.
